Carta abierta de los expertos de Internet a Antonio Tajani


Publicamos la traducción de la carta abierta que destacados pioneros y expertos de Internet, entre los que se incluyen Tim Berners-Lee, Vinton Cerf, Tim O'Reilly, Bruce Schneier, Jimmy Wales, y así hasta más de 70 han dirigido a todos los miembros del Parlamento Europeo en general y a su Presidente, Antonio Tajani en particular para mostrar su más profundo rechazo y preocupación por el Artículo 13 de la propuesta de reforma del Copyright, que de aprobarse la próxima semana en el Comité de Asuntos Legales implantaría la censura previa de facto en toda la Unión Europea. desde la Asociación de Internautas creemos que la carta es suficientemente explícita como para que alguien en Bruselas aún siga defendiendo este artículo sin que resulte algo sospechoso.

Sr. Presidente,

Como grupo de arquitectos y pioneros originales de Internet y sus sucesores, le escribimos de forma urgente sobre una amenaza inminente para el futuro de esta red global.

La idea de la Comisión Europea para el Artículo 13 de la propuesta Directiva del Copyright en el Mercado ünico Digital era bien intencionada. Como creadores nosotros mismos, compartimos la preocupación de que debería existir una remuneración justa de beneficios por el uso online de obras protegidas por derechos de autor, que beneficie a creadores, editores y plataformas por igual.

Pero el Artículo 13 no es la forma correcta de conseguir esto. Al obligar a las plataformas de Internet a realizar un filtrado automático de todo el contenido que sus usuarios suben, el Artículo 13 establece una vía sin precedentes hacia la transformación de Internet de una plataforma abierta para compartir e innovar, a una herramienta para la vigilancia y control automatizados de sus usuarios.

Europa se beneficiaba por el modelo de responsabilidad equilibrada establecido bajo la Directiva de Comercio Electrónico, bajo la cual aquellos que suban contenido a Internet afrontan la responsabilidad principal por su legalidad, mientras que las plataformas son responsables de actuar para eliminar ese contenido una vez que se les haya comunicado su ilegalidad. Al invertir este modelo de responsabilidades y esencialmente hacer a las plataformas directamente responsables de asegurar la legalidad del contenido en primera instancia, los modelos de negocio y las inversiones de las plataformas tanto pequeñas como grandes se verán impactados. El daño que esto puede hacer a una Internet libre y abierta como la conocemos es difícil de pronosticar, pero en nuestra opinión podría ser considerable.

En particular, lejos de afectar sólo a las grandes plataformas de Internet norteamericanas (que bien pueden permitirse el coste del cumplimiento) la carga del Artículo 13 recaerá con mayor dureza sobre sus competidores, incluídas las startups y las pymes europeas. El coste de establecer las necesarias tecnologías de filtrado automático será elevado y oneroso, y además esas tecnologías no están desarrolladas hasta el punto en que su fiabilidad pueda garantizarse. Es más, de haber existido el Artículo 13 cuando se diseñaron los protocolos y aplicaciones centrales de Internet, sería muy poco probable que hoy existiera tal y como la conocemos.

El impacto del Artículo 13 también recaería fuertemente sobre los usuarios normales de las plataformas de Internet - no sólo aquellos que suban música o vídeo (con frecuencia en sintonía con las limitaciones y excepciones del copyright, que el Artículo 13 ignora) sino incluso aquellos que aportan fotos, texto o código informático a plataformas colaborativas abiertas tales como la Wikipedia o GitHub.

Los académicos también dudan sobre la legalidad del Artículo 13; por ejemplo, el Instituto Max Planck para la Innovación y la Competitividad ha escrito que "obligar a ciertas plataformas a aplicar tecnología que identifica y filtra todos los datos de todos y cada uno de sus usuarios antes de haber sido subidos a los servicios públicamente disponibles es contrario al Artículo 15 del la Directiva InfoSoc así como a la Carta Europea de Derechos Fundamentales"

Una de las disposiciones particularmente problemáticas del Artículo 13 como fue propuesto originalmente por la Comisión, y en los textos consensuados promulgados por el Consejo y por el Parlamento, es que ninguna de estas versiones del texto proporcionaría ni claridad ni consistencia en sus intentos de definir qué plataformas de Internet serían obligadas a cumplir la disposición, y cuáles quedarían exentas. La incertidumbre empresarial resultante sacaría a las plataformas online de Europa y les impediría proporcionar servicios a los consumidores europeos.

Apoyamos la consideración de medidas que mejoren la capacidad de los creadores para recibir una remuneración justa por el uso de sus obras online. Pero no podemos apoyar el Artículo 13, que obligaría a las plataformas de Internet a incrustar una infraestructura automatizada de monitorización y censura en lo más profundo de sus redes. Por el bien del futuro de Internet, le instamos a que Vd. vote la eliminación de esta propuesta.
